A. Information on the right of withdrawal

1. Right of withdrawal

The Consumer has the right to withdraw from the contract within 14 days without giving any reason.

In the case of purchase of a single product, the withdrawal period ends after 14 days from the day on which the Consumer, or a third party designated by him other than the carrier, acquires physical possession of the product.

In the case of multiple products ordered through a single order and delivered separately, the withdrawal period ends after 14 days from the day on which the Consumer, or a third party designated by him other than the carrier, acquires physical possession of the last product.

In the case of a product consisting of multiple lots or pieces delivered separately, the withdrawal period ends 14 days after the day on which the Consumer, or a third party designated by the Consumer other than the carrier, acquires physical possession of the last lot or piece.

2. How to exercise the right of withdrawal

To exercise the right of withdrawal, the Consumer must communicate his decision through an explicit declaration before the withdrawal period expires.

The withdrawal can be communicated through one of the following methods:

Digital withdrawal function

The Consumer may use the digital function available on this page. The function allows the Consumer to communicate the decision to withdraw by providing or confirming their name, the information needed to identify the order or contract, and an e-mail address associated with the request.

After the form has been completed, a summary is displayed. The request is submitted only after the Consumer has selected the express confirmation and pressed “Confirm withdrawal”.

After submission, the function displays an acknowledgement of receipt without undue delay, including a summary of the request and the date and time of submission. The receipt can be downloaded and retained.

Communication via e-mail

The Consumer can communicate his decision to withdraw by sending an explicit declaration at the address info@guestside.it.

The communication should contain at least:

• name and surname;
• order number;
• indication of the products for which the withdrawal is exercised;
• address at which to receive communications relating to the request.

Model withdrawal form

The Consumer can use the standard form shown in section B of this page. The use of the form is not mandatory.

To meet the withdrawal deadline, it is sufficient for the communication concerning the exercise of the right to be sent before the 14-day period expires.

3. Effects of withdrawal

In case of valid exercise of the right of withdrawal, GuestSide refunds all payments received in relation to the products subject to the withdrawal, including any costs incurred for the standard delivery method.

Any additional costs deriving from the choice by the Consumer of a different and more expensive delivery method than the least expensive standard method offered by GuestSide will not be reimbursed.

The refund is made without undue delay and in any case no later than 14 days from the day on which GuestSide was informed of the Consumer's decision to withdraw from the contract.

The refund is made using the same payment method used for the initial transaction, unless the Consumer has expressly agreed to a different method and provided that he does not incur any costs as a result of the refund.

GuestSide may withhold the refund until the products are received or until the Consumer provides evidence that they have been returned, whichever occurs first.

4. Return of products

The Consumer must return the products without undue delay and in any case within 14 days from the day on which they communicated their decision to withdraw.

The deadline is met if the products are sent before the 14-day period expires.

Before shipping, the Consumer is invited to check any instructions received from GuestSide, in order to allow the correct identification and management of the return.

The direct costs of returning the products are borne by the Consumer.

The Consumer may freely choose the carrier used for the return and is advised to use a service that allows shipment and delivery to be tracked.

The Consumer is liable only for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

5. Conditions of returned products

The Consumer may examine and manipulate the products to the extent necessary to verify their nature, characteristics and functioning, similarly to what would reasonably be possible to do in a point of sale.

Further handling may result in a decrease in the value of the product, for which the Consumer may be liable within the limits laid down by applicable law.

The products must be returned, as far as possible, complete with:

• accessories;
• components;
• instructions;
• any elements supplied with the product.

The lack or damage to the original packaging does not automatically lead to the loss of the right of withdrawal. Any decrease in value is assessed in relation to the actual conditions of the product and the manipulations carried out.

6. Exclusions from the right of withdrawal

The right of withdrawal does not apply in the cases provided for by current legislation.

With reference to the products marketed by GuestSide, the following exclusions may be relevant, when the conditions are concretely met:

• products made to measure or clearly personalized;
• products which risk deteriorating or expiring rapidly;
• sealed products which are not suitable for return for reasons of hygiene or health protection and which have been opened after delivery;
• products which, after delivery, are by their nature inseparably mixed with other goods.

Any exclusion is clearly indicated on the product page or in any case before the conclusion of the purchase, when applicable.

Simply opening the package does not automatically determine the loss of the right of withdrawal. The exclusion relating to hygienic products or products connected to health protection applies exclusively when all the requirements established by law are met.
